またしてもというか、残業代訴訟で会社が敗訴したようです。

変形労働時間制を理由に残業代を払わないのは不当だとして、
外食チェーン「洋麺（めん）屋五右衛門」の元アルバイトの男性（２８）が、
店を運営する日本レストランシステム（本社・東京）に２００６年３月～
０８年２月の未払い残業代など計約２１万円の支払いを求めた訴訟の
判決が７日、東京地裁であり、藤井聖悟裁判官は同社に約１２万３千円の支払いを命じた。
判決によると、同社は一定期間の労働時間が平均週４０時間以内であれば、
特定の日に８時間を超えて働かせることなどができる変形労働時間制を
アルバイトに採用した。しかし、期間中のすべての労働日や労働時間を
事前に決めないなど、労働基準法が定めた変形労働時間制の要件を守らず
無効であると指摘。１日８時間を超える時間外労働については、割り増し
残業代の支払いが必要だと判断した。

強行法規である労基法の要件を満たせていない変形労働時間が
無効とされるのは、ある意味当然です。
が、それよりも恐いのが、約6,000人のアルバイトが同様の状態にある
という原告代理人の指摘です。
今回は労働者1人の提訴だから120,000円程度で済んでいますが、
仮に6,000人のアルバイト全員に120,000円の残業代を支払うことになれば
その総額は、軽く7億円オーバー。
同様の訴訟を相次いで起こされた場合、企業にとっては
それこそ死活問題に発展します。
外食産業を含め、経営の存続そのものを流動的な労働力であるアルバイトに
頼らざるを得ない業界にとっては、今後ますます厳しい時代になりそうです。
なので、労働時間管理は、できる限り適当にやらないことが大事です。
